Can I make a workplace accident claim in Northern Ireland?
Yes, if you’ve been injured in an accident at work because your employer failed to keep you safe, you’re entitled to make a workplace accident claim.
Your employer has a duty of care to you. You’re eligible to make an accident at work claim if:
- You had to work in unsafe conditions
- Health and safety legislation was not in place
- Health and safety training was inadequate
- You were not given the correct personal protective equipment (PPE)
- Equipment or machinery was faulty or poorly maintained
- Workplaces were unsafe, unorganised or unclean
Even if a workplace accident was partly your fault, you can still claim if it was also caused or worsened by any of those factors.

Workplace Accident Claims FAQs
Yes, you can make a work accident claim even if you’re still working for the same employer. Employers are required to have insurance cover for injuries to their staff. The insurance company will pay your work accident claim compensation, so you shouldn’t have concerns about any financial impact on your employer.
Yes, you can make work accident claims against a former employer. The only requirement is that the accident happened within the last three years, or you only became aware within the past three years that you sustained a workplace injury while working for your old employer.
You can’t make a no win, no fee accident at work claim in Northern Ireland. Along with all no win, no fee claims, they are not allowed under the law here. As an alternative, we offer a free initial consultation. This will include advice on the strength of your workplace injury claim and guidance on how much compensation you could receive.
We will also pursue your employer’s insurer to cover all of your legal costs in addition to your compensation payout.
The time limit for accident at work claims in Northern Ireland is usually three years from the date of the accident. There are some exceptions to this time limit. If you only became aware of the injury later — such as being diagnosed with a condition relating to workplace asbestos exposure — you can make an accident at work claim up to three years from the date you became aware of the injury.
If you were under 18 at the time of your workplace accident, you can claim up to your 21st birthday. If the injured party doesn’t have the mental capacity to make a claim, there is no time limit.
How much accident compensation you get will depend on how serious your injuries were, the long-term effect of your accident and any other hardship you’ve endured because of the accident.
Workplace injury compensation in Northern Ireland is based on the Green Book. This provides guideline compensation amounts for accident at work claims and other personal injury claims.
Workplace accident compensation varies from less than £1,000 for minor injuries to more than £1m in the most serious cases.
As well as compensation for the pain and suffering you’ve experienced, you’re also entitled to compensation for any financial losses. This could include loss of earnings, medical and physio fees, and adjustments to your home or transport due to your injuries.

No, you can’t be sacked for making an accident at work claim, nor can you be sacked for sustaining an injury at work. You are protected by the employment law in Northern Ireland, which means it is illegal for an employer to sack you for making a compensation claim.
It’s highly unlikely that your workplace accident claim will go to court. In most cases, we’re able to reach a settlement with the employer’s insurer to secure the compensation you deserve. But going to court remains a useful option if an insurer refuses to agree to a fair compensation amount.
Should your claim go to court, we will guide you through the process from start to finish.
