Power of attorney is a legal document giving someone else the authority to make important decisions relating to your finances and property. An attorney is somebody appointed to represent another person’s interests. A power of attorney is the document that legally gives them those powers.
If your chosen attorney believes you are becoming mentally incapable of managing your affairs, they can apply to the High Court (Office of Care and Protection) to register the enduring power of attorney (EPA).
Once registered, the enduring power of attorney gives them the authority to handle your property and finances almost as easily as they can their own – as long as they do so in your interests.
If you don’t have an enduring power of attorney in place and lose the mental capacity to look after your affairs, it’s harder and more expensive for your loved ones to take care of things for you.
In this case, your affairs will instead be managed through controllership. This is when the courts appoint somebody to look after your property and finances. Keep in mind, this might not be the person you would have chosen. That is why making an enduring power of attorney is so important.
